Terms and Conditions
1. General
The Company means Tomorrow's Energy LTD.
All quotations are made and orders accepted subject to the following expressed terms and conditions and no additions or alterations shall apply unless specifically agreed to in writing by a Company Director.
2. Our Responsibilities
a) We will carry out our work in accordance with
the Tomorrow's Energy Agreement on our written quotation.
b) We will use all reasonable endeavours to
complete the work by the estimated date.
However, we will not be held responsible for
delays beyond our reasonable control including,
but not limited to, fire, flood, inclement weather,
civil disturbance, strike action by others, criminal
action or war or delays caused by sub¬
contractors. In these circumstances we will
complete the work as soon as reasonably
possible.
c) We will remove all building rubble from the site or dispose of them in allocated bins or areas and will on completion leave all surfaces clean and tidy.
3. Your Responsibilities
a) You will permit us, during normal working hours,
first to conduct the technical survey, and then
with reasonable notice to undertake the
Installation and any service work required.
b) You will ensure that all our working areas are
free and clear of obstruction.
c) You acknowledge you are responsible to obtain
any permission (such as landlord's consent,
local authority approval) prior to the Company
undertaking the installation. Our assistance in
dealing with these matters is available.
4. Things you should know
a1) Thermal: The installation is a solar water heating system for hot water and/or swimming pools and unless specified in writing space heating is not provided for.
a2) Electricity: The installation Is a solar PV system for a grid connected electricity system.
c) All drawings, descriptive matter, specifications
and advertising issued by us and any
illustrations contained in our catalogue or
brochures are issued to give you an
approximate idea of the goods or services
described in them. They do not form part of the
contract.
d) The materials listed for installation may be
replaced with materials of a similar performance
and quality when it is reasonably necessary to
do so.
5. Prices & Terms of Settlement
The Company's terms of settlement are indicated. The Customer agrees to pay the agreed price for the goods and service strictly in accordance to the Agreement. Failure to comply will result in a 0.5% surcharge per week,
The Company has the right to invoice the Customer any discount amount if payment conditions are not strictly adhered to.
Unless otherwise specified in writing, prices given in the Agreement are valid for a maximum of six months.
6. Passing of Title
Title to or the property of Company's goods shall not pass until payment has been received in full.
7. Warranty
The system supplied and installed by the Company is warranted against mechanical and electrical defects arising from faulty workmanship or materials for a period of 12 months, from the date of installation and commissioning. If the system fails to operate correctly, we undertake to repair or replace, without charge, any parts found to be defective during the warranty period, except where the defect is due to misuse, neglect or damage. The Customer is not allowed to contract any repair work to a third party. Modification to the system or alteration to the controller setting by unauthorised persons is not allowed. The Company will not be responsible for any expenses whatsoever other than repairing or replacing of the defective parts.
Goods supplied only (not installed by the Company), are warranted against defect for 12 months from the date of sale by the Company unless stated otherwise In writing by the Company, The Company's obligation is limited to replacing or repairing the defective parts, excluding carriage and Purchaser's labour cost. It is expected that the Purchaser maintains full details of the product. The Company shall have no liability to replace detective parts unless the Purchaser gives the Company notice of detect immediately the same Is ascertained. The Company will not be responsible for any expenses whatsoever other than repair or replacement of defective parts.
The warranty by the Company is in addition to and separate from the right the Purchaser may have under the Sale of Goods Act and under any other legislation.
The output of a solar system will be variable, depending on the amount of solar radiation it receives. No specific amount of output and saving can be guaranteed.
8. Cancellation
No penalty is payable by the Customer if an order is cancelled within 7 days. Thereafter, 25% of the order value Is chargeable plus any costs incurred by the Company towards the preparation / implementation of the order.
9. These conditions do not affect your
statutory rights.
